Hoeven Statement After EPA Issues Guidance on Section 401 of the Clean Water Act

WASHINGTON – Senator John Hoeven issued the following statement after the Environmental Protection Agency issued guidance on Section 401 of the Clean Water Act as directed by the President’s Executive Order 13868 “Promoting Energy Infrastructure and Economic Growth.”  EPA’s guidance modernizes and clarifies the existing requirements for the water quality certification process. The President executive order on April 10 required EPA to issue this guidance within 60 days. With this guidance issued, the EPA must propose new regulations within 120 days.

“Our nation needs to invest and build energy infrastructure to meet our needs now and into the future,” said Hoeven. “We look forward to working with EPA to ensure that section 401 is implemented in accordance with statute and to ensure that our nation can build important energy infrastructure with good environmental stewardship, while maintaining cooperative federalism.”
