BISMARCK, N.D. – Senator John Hoeven, a member of the Senate Energy and Natural Resources Committee, issued the following statement after the Environmental Protection Agency (EPA) issued guidance clarifying that oil and gas producers can continue routine flaring at new oil wells in some circumstances after the May 7, 2026 phase out deadline. EPA issued the guidance in response to concerns from oil and gas operators that the flaring phase out, put in place by the Biden administration, would force them to halt production when scenarios outside their control require flaring.
“We need to produce more energy here at home, not only to lower prices for consumers but because energy security is national security,” said Hoeven. “We appreciate the Trump administration for providing this much-needed clarity for producers, including those in the Bakken, that will enable them to continue their operations.”
In 2023, Hoeven and the North Dakota delegation worked to stop the Biden administration’s duplicative methane rule that put in place the phase out deadline.
